Terms of Use

These Terms of Use ("Terms") govern your use of the Discography mobile application ("App"). By downloading, installing, or using the App, you agree to these Terms.

1. Operator

The App is provided by Ruhter Enterprises ("we," "us," or "our").

2. Eligibility and Acceptance

You must comply with applicable laws and Apple App Store terms when using the App. If you do not agree to these Terms, do not use the App.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use on Apple-authorized devices.

You may not:

• Copy, modify, distribute, sell, or lease the App except as permitted by law.
• Reverse engineer or attempt to extract source code, except where prohibited by applicable law.
• Use the App in ways that violate law or third-party rights.

4. App Functionality and Dependencies

The App depends on Apple platform services and permissions (including Media Library access) and may use Apple iTunes endpoints for discography metadata.

Availability and accuracy of third-party data/services are outside our control.

5. User Responsibilities

You are responsible for:

• Your device settings, permissions, and local media library configuration.
• Compliance with terms that apply to your music content and Apple services.
• Any exports or shares you initiate from within the App.

6. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant uninterrupted service, complete accuracy of metadata, or that the App will be error-free on all devices/configurations.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION ARISING FROM OR RELATED TO YOUR USE OF THE APP.

Our total liability for any claim related to the App is limited to the amount you paid for the App, if any.

8. Indemnity

You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the App or violation of these Terms.

9. Privacy

Your use of the App is also governed by the Privacy Policy published for Discography.

10. Termination

These Terms remain in effect until terminated. We may suspend or terminate your license if you violate these Terms. You may terminate at any time by discontinuing use and deleting the App.

11. Changes to the App or Terms

We may modify, suspend, or discontinue app features at any time. We may also update these Terms. Continued use after updated Terms are posted means you accept the updated Terms.

12. Export and Legal Compliance

You agree to comply with all applicable export control and sanctions laws.

13. Governing Law

These Terms are governed by applicable laws of the United States and the state where the operator is based, without regard to conflict-of-law rules, unless required otherwise by applicable consumer law.

14. Apple-Specific Terms

These Terms are between you and Ruhter Enterprises, not Apple. Apple is not responsible for the App or its support. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms.
